These terms govern your use of the Aquvix app and of Aquvix rescue buoy equipment rented from a partner facility. They are an agreement between you and WaitingMap, referred to here as “we”. By pairing a wrist tag and starting a session, you accept them.
1. What the service is
Aquvix is a self-following rescue buoy. You wear a wrist tag; the buoy follows that tag at a set distance while you swim. Pressing the tag button once brings the buoy to you. Pressing and holding brings the buoy to you and raises an SOS with the facility’s control desk.
The equipment is rented from the facility, not from us. The facility hands out the wrist tag, supervises the water, and responds to an SOS. We provide the equipment, the app and the software that carries alerts to the facility.
2. Eligibility
- You must be 13 or older to register an account.
- A minor may use the equipment only where an accompanying adult registers the session and supervises it throughout.
- You must be physically fit to swim and must follow the facility’s rules, posted warnings and staff instructions.
3. Using the equipment
You agree to:
- pair the wrist tag by scanning its QR code, and use only the tag and buoy issued to you;
- stay within the swimming area the facility designates, and leave the water when staff tell you to;
- end the session in the app when you finish, and return the tag and buoy to the front desk;
- not modify, open, disassemble or attempt to repair the equipment, and not use it for anything other than personal recreational swimming.
A rental is not complete until staff confirm the equipment has been returned.
4. Loss and damage
You are responsible for the equipment from the moment it is issued until the facility records it as returned. If it is lost or damaged beyond normal wear while in your care, the facility may charge you for repair or replacement under the terms it gave you at the desk. Report any fault or damage to staff immediately — do not keep swimming with equipment you believe is faulty.
5. The app
The app is a viewer. It shows where the buoy and the swimmer are, battery and link state, and the progress of a rescue. Positions are measured by the buoy, not by your phone. We grant you a personal, non-transferable licence to use the app alongside a rental, and we may change or discontinue features.
The app needs a working network connection to show live status and to raise an SOS. Coverage at a beach or on the water is outside our control.
6. Safety — please read this section
Aquvix is an assistive device. It is not a lifejacket, not a personal flotation device, and not a substitute for a lifeguard, for supervision, or for your own judgement about whether it is safe to swim.
Do not enter water you would not enter without it. Do not swim alone, beyond your ability, or outside supervised areas because you are wearing a tag. Always follow the facility’s flags, signage and staff instructions.
The equipment can fail to reach you or to raise an alert. In particular:
- batteries run down, and the buoy or tag can lose power mid-session;
- the wireless link between tag and buoy can drop, and mobile coverage can be absent on the water;
- waves, currents, wind, boat traffic and obstacles can prevent the buoy from reaching you or delay it;
- an SOS depends on the facility’s staff receiving and acting on it.
If you are in difficulty, signal for help by every means available to you. Do not wait for the buoy.
7. Limitation of liability
Nothing in these terms limits liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot be limited under the law that applies to you.
Subject to that, and to the fullest extent the law allows, we are not liable for loss arising from equipment malfunction, loss of signal, battery exhaustion, delayed or undelivered alerts, or the acts or omissions of a facility or its staff. The equipment is supplied without any warranty that it will prevent drowning or injury.
8. Accounts and data
You are responsible for the accuracy of the details you give at sign-up, including your emergency contact. How we handle your data is described in our Privacy Policy.
9. Suspension
A facility may end a session and reclaim the equipment at any time, including for unsafe behaviour or on weather grounds. We may suspend an account that abuses the service or the equipment.
10. Changes to these terms
We may update these terms as the product changes, and will revise the effective date above. Continuing to use the service after a change means you accept the updated terms.
11. Governing law
These terms are governed by the laws of the Republic of Korea, and the courts of the Republic of Korea have jurisdiction, except where the law of your country of residence gives you the right to bring a claim locally. Nothing here removes a consumer right you have by law.
